The Tutors’ Association - Tuition in Elevated Risk Context
Background and Purpose
The Tutors’ Association (TTA) always expects members to treat the health and safety of their clients and students (as well as any tutors they employ, engage or work with) with the utmost priority. However, we recognise that there are situations where an elevated level of background risk exists but where normal life must continue as best as possible, where the risk falls short of necessitating immediate evacuation/relocation.
TTA would expect any member to act prudently and sensibly when assessing risk; tutorials should not take place, or should be cancelled (even at very short notice or if they are in progress) where there is a sudden and unpredictable threat to the safety of students and tutors. These template terms are not for use in such immediately threatening circumstances where it is clearly more appropriate for lessons to be cancelled so that students and tutors can move to a safer environment.
These additional terms are designed for use by TTA Members operating, temporarily or permanently, in such an environment with an elevated level of background risk, that falls short of requiring immediate evacuation. The possible circumstances when this might become necessary could include:
● An environment in, adjacent to, or at risk of becoming a conflict zone.
● Where there has been a threat of terror attack (but not specific or imminent enough to ascertain when or where such an attack might take place).
● In an environment with a relatively high background level of crime or criminal activity.
● Periods of civil unrest, rioting or where there is a material risk of such unrest.
● In an environment where there is a risk of a natural disaster that is not imminent or expected but elevated beyond normal background levels.
● Where the student has a medical condition that can lead to the sudden and/or unpredictable onset of symptoms or conditions that could put that student at risk (e.g. severe epilepsy or certain heart conditions).
Addendum: Protocol for students attending face-to-face or online lessons during periods of elevated risk
1. During any period of elevated risk, the physical safety of Students remains primarily the responsibility of their parent at all times. If a parent is unable to be physically present during a lesson, they must designate a responsible adult (other than the tutor) who agrees, in writing, to take responsibility for the safety of their Student (the parent or responsible adult designated by the parent shall be referred to as the “Guardian”).
1.1. When face-to-face or online tuition is taking place, the Guardian must stay in close proximity to the lesson, within the same building or within a designated location in the vicinity of the lesson as clearly indicated by the tutor or tuition provider.
1.2. For online lessons, parents must provide the mobile number and, where appropriate, other contact details (such as WhatsApp, WeChat or Telegram ID, and/or email address) of the designated adult with responsibility for the safety of their student, in case it is not possible to attract the Student’s attention through the screen.
1.3. The Guardian shall be available to respond to any incident requiring immediate termination of the lesson and evacuation (such as an alert, alarm, attack, natural disaster, adverse weather or concerning activity by any third parties) and shall immediately take responsibility of the Student, either:
1.3.1. when directed to do so by the tutor or tuition provider; or,
1.3.2. when, in the reasonable opinion of the Guardian, it is necessary to terminate the tuition due to a deterioration in the safety and security of the environment (however caused).
1.4. For the avoidance of doubt, neither the tutor or any corporate tuition provider can be held liable for the safety and security of the Student or the Guardian, other than where the safety or security of either the Student and/or Guardian is compromised by a malicious or negligent action or omission by the tutor or tuition provider. The Guardian shall remain liable at all times for their own and the Student’s safety and security.
2. Students and Guardians remain responsible for following the directions of any relevant and legitimate government/ authority at all times, including:
2.1. Responding immediately to mobile phone alerts and following instructions.
2.2. As soon as a mobile alert sounds, the Guardian moving into physical proximity of the student and taking responsibility for that Student’s safety and compliance with the instructions of any relevant authority.
2.3. Ending the lesson if it suddenly or unexpectedly becomes (or is likely to become) unsafe to continue, enabling the tutor to also make provisions for their own safety.
2.4. Where a secure refuge, shelter, bunker or similar exists, both the tutor and the Guardian shall, to the greatest extent possible, each ensure that the Student(s), tutor(s) and Guardian(s) shall have access to it.
2.5. Restarting the lesson only when the tutor agrees it is safe to do so.
3. The safety and wellbeing of the student is the priority at all times, and any safeguarding concerns must be reported immediately using the agreed procedures.
